The People’s Portrait Game of Chance Terms and Conditions
- General
- This promotion is conducted, and the prize administered, by the National Portrait Gallery (ABN 54 74 277 1196) (“The Promoter”).
- A vote submitted via the National Portrait Gallery of Australia website, through The People’s Portrait subsite, by the deadline, comprises “an entry”.
- This promotion is a game of chance. It is free to enter, and each eligible entry has an equal chance of winning.
- This information and the instructions relating to this promotion on this website forms the Terms and Conditions. By completing an entry, the entrant accepts these Terms and Conditions.
- In the event of any inconsistency between these Terms and Conditions and any other reference to this promotion, these Terms and Conditions prevail.
- The Promoter reserves the right to amend these Terms and Conditions.
- The Promoter may also cancel or suspend this competition and its prize if an event beyond the control of the Promoter corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition or its prize. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
- The Promoter reserves the right to cancel, suspend or proceed with the People’s Portrait commission at its sole discretion, and in accordance with its Collection Development Policy.
- Who can enter?
- To enter you must be aged 18 years or over at the time of entry.
- The promoter reserves the right to request winners to provide proof of identity. Identification considered suitable for verification is at the discretion of the promoter.
- Directors and employees of the Promoter (together with their immediate families) are not eligible for entry.
- How to enter
- Entries will open at 9:00am on Friday 16 August 2024 and close at 11:59pm AEDT on Sunday 15 December 2024.
- Entrants must submit their entry in by submitting a vote in ‘The People’s Portrait’ online voting campaign, in accordance with the instructions provided on the National Portrait Gallery website.
- Entrants must also include their full name, age (must be over 18), email address, phone number and postcode.
- All details provided by the entrant must be true and accurate.
- Only one entry per entrant is permitted.
- Draw
- Two (2) winners will be randomly drawn by the Promoter at the National Portrait Gallery of Australia, King Edward Terrace, Parkes ACT at 11:00am AEDT on Thursday 30 January 2025.
- The winners will be notified by Friday 7 February 2025 to confirm acceptance of the prize. All reasonable attempts will be made to contact the winner. However, if the prize is not claimed by 11:59pm AEDT time at 28 February 2025, the Promoter reserves the right to select another winner or not award the prize. It is the entrant’s responsibility to ensure their contact details are correct when entering the competition.
- The two (2) winners will be announced to the public by listing the name of the winner on the Promoter’s website.
- No responsibility by the Promoter is accepted for late, lost or misdirected entries.
- The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into.
- The prizes are not transferable, not refundable and not redeemable for cash. The Promoter reserves the right to redeem all unclaimed prizes and dispose of them at its absolute discretion.
- Prize
- Two winners will each receive a Qantas gift voucher to the value of $1000 (“the Prize”).
- The Promoter may share personal details of the winners with the third party to redeem the Prize.
- The Promoter will email the Prize to the winners within 30 days of receiving confirmation from the winner per 5.2.
- Entrants acknowledge the Prize is supplied by a third party (Qantas) and carries its own terms and conditions for use. The Promoter accepts no liability for changes in third party terms and conditions of use.
- The prize cannot be exchanged or transferred and is not redeemable for cash.
- If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
- The Prize is generously donated by the Sid and Fiona Myer Family Foundation.
- Website use
- The Promoter cannot guarantee the continuous integrity of its servers. As a result, you may at times experience disruption or other difficulties in using the Promoter’s website. The Promoter has no liability for loss or costs of any kind you suffer as a result of or in connection with any disruption or other difficulties in using the Promoter’s website. The Promoter is not responsible for any failure of equipment or technical error associated with the competition. Or for any incorrect information, commission, interruption or delay in operation.
- Privacy collection statement
- By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
- The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner). The Promoter may disclose personal information collected to an agent who is engaged for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy. - This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social network. The entrant is providing information to the Promoter and not to any other party. The information provided will be used in accordance with the Privacy Policy of the National Portrait Gallery.
- Liability and governing law
- This competition is governed by the laws of the Australian Capital Territory.
- Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under the Australian Securities and Investment Commission Act 2001 (Cth) or consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’).
- In respect to this competition, except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any tax liability incurred by the winner or Entrant.
